Rights arising from a hindrance of competition (Cartel Act) / Ansprüche aus Wettbewerbsbehinderung (KG) / Azioni per limitazioni della concorrenza (LCart)

ENGLISH

A person hindered by an unlawful restraint of competition from entering or competing in a market is entitled to request: the elimination of or desistance from the hindrance; damages and satisfaction in accordance with the Code of Obligations and surrender of unlawfully earned profits in accordance with the provisions on agency without authority.

Hindrances of competition include in particular the refusal to deal and discriminatory measures.

Wer durch eine unzulässige Wettbewerbsbeschränkung in der Aufnahme oder Ausübung des Wettbewerbs behindert wird, hat Anspruch auf: Beseitigung oder Unterlassung der Behinderung; Schadenersatz und Genugtuung nach Massgabe des Obligationenrechts und Herausgabe eines unrechtmässig erzielten Gewinns nach Massgabe der Bestimmungen über die Geschäftsführung ohne Auftrag.

Als Wettbewerbsbehinderung fallen insbesondere die Verweigerung von Geschäftsbeziehungen sowie Diskriminierungsmassnahmen in Betracht.

Chiunque è impedito nell’accesso o nell’esercizio della concorrenza da una limitazione illecita della stessa può chiedere: la soppressione o la cessazione dell’ostacolo; il risarcimento del danno e la riparazione morale secondo il Codice delle obbligazioni1 e la consegna dell’utile illecito conformemente alle disposizioni della gestione d’affari senza mandato.

Si considerano in particolare ostacoli alla concorrenza il rifiuto di relazioni commerciali e le misure discriminanti.
