La Sfida

The artworks by A. M. A. often revert to experiences from her life. For this painting with the title “La Sfida” (in English “The Challenge”) she uses warm colours. It seems inspired by her time in Africa. An arcane mysticism frames the scene. The rolling lines seem elegant and slightly playful.la sfida -ama

A. M. A. begann painting by the age of 14. A lot of her knowledge she has taught herself autodidactically. But she also graduated in several studies. She calls her style “Neo Futurism”. In Rome she’s already had numerous exhibitions. At the art festival “King of Rome” she has been a guest many times.

Dominique Calcò Labbruzzo has written an article about art and (Swiss) law in the June-issue 2013 of the periodical SwissNews. In the article the attorney discusses the different actions buyers of forgeries can file, not only from a criminal point of view but also from a civil one. A special focus lays on the contracts with auction houses, which usually don’t provide any recompense of the purchase price in case of forgery in their general terms of conditions. However, this clause could be void based on the new article 8 of Federal Law Against Unfair Competition of July 1st, 2012.

The Contract of Surety

Dominique Calcò Labbruzzo has published a new article in the newspaper LaPagina. She clarifies the Contract of Surety. Subsequent is a short summary of the article.

 

The Contract of Surety

Under a contract of surety, the surety undertakes as against the creditor of the principal debtor to vouch for performance of the obligation.

A contract of surety presupposes the existence of a valid primary obligation. A future or conditional obligation may be guaranteed by means of a contract of surety provided that the primary obligation takes effect.

The contract of surety is valid only where the surety makes a written declaration and indicates in the surety bond the maximum amount for which he is liable.

Where the surety is a natural person, his declaration must additionally be done in the form of a public deed in conformity with the rules in force at the place where the instrument is drawn up. Where the liability under surety does not exceed the sum of 2,000 francs, it is sufficient for the surety to indicate the amount for which he is liable and the existence of joint and several liability, if any, in his own hand in the surety bond itself.

A married person may validly stand as surety only with the written consent of his spouse given in advance or at the latest simultaneously, unless the spouses are separated by court judgment.

The spouse’s consent to subsequent amendments of a contract of surety is required only where the total liability is to be increased or a simple surety is to be transformed into a joint and several surety, or where the effect of the amendment is to diminish the level of security substantially.

The same applies mutatis mutandis to registered partners.

Manderley

This piece of art by the artist G. N. shows an abstract setting, inspired by the visit of the musical “Rebecca” after the correspondent novel by Daphne du Maurier in Stuttgart. The story is about a young woman who marries the widowed aristocrat Maxim de Winter and on his country residence Manderley, after which the painting is named, she is confronted by the enigma about the mysterious death of Maxim’s first wife Rebecca.manderley - gn

G. N. was born in Germany and has spent part of her childhood in Switzerland where, imbued by study trips around the world, her artistic creation begun in the mid-90’s. Since then her art evolved and she was able to exhibit inter alia in France and Austria.
